Sorry for the CAPS SPAM, but this message is *VERY IMPORTANT* and I hope everyone will read it. :please:

Tuxedo Dan - a model who's image is in some older SenshiStock posts - has rescinded his rights for the distribution of his image.  I have moved all images featuring Tuxedo Dan into storage.

NO PHOTOGRAPHIC-BASEED PERSONAL OR COMMERCIAL ARTWORKS ARE TO BE CREATED FEATURING TUXEDO DAN.

If you have photos of him saved in your personal reference folders (or, if you have a SenshiStock USB drive), please note that he has told me that it's still okay for those people to use them for pose reference. You can still draw your own artwork using his poses as a reference, but his photographic likeness must *NOT* be used in any work, commercial or personal.  Please continue to credit SenshiStock in images where you have referenced his likeness and send me links to the work if it's posted online.  His images will no longer be sent out on future USB purchases.

I am sad to have to remove any stock images from the gallery, but I must respect the rights and wishes of my models. I am sure everyone can understand that. :thanks:

I know that stored images on DA are annoying. I wish they'd make it so they didn't show up in searches and groups and favorites.  However, this seems like the best solution. In the future, if he changes his mind, the images can be restored easily.

Please note: there is also a Moonlight Dan in the gallery. His images are still available and have the same license as before.

Thank you all so much for reading and understanding. I hope that I can reproduce some of the poses that we did in that shoot with another model in the future!

Sorry to hear that; to judge from the comments, it seems like good male stock pictures are somewhat hard to find. Here's hoping everyone has luck doing so.

lol, I THINK I get it...we can still draw his poses (if we have any saved on our computer) but we just can't draw his...facial likeness :?

Haha yeah kinda. Well it's more important that his actual FACE isn't in any art. I guess if you were drawing a super photorealistic image that might not make him happy, either, but I think so long as it's a DRAWING and not an actual image of his head, you should be fine ^__^

Aww... and I just started to really explore your gallery! You're one of few that I really like because you show the form, allowing me to add clothing the way I want to--as opposed to the photographer's choices. Hopefully you can get some more!

After maing The-wolfpack-stock me and my friends realized tha tsome people can be - no offance - crazy :DMost of them are cool, but still i would understand if a model choose not be here anymore.

Oh good. Well, tell him there's a lot of wonderful fans that appreciated what he did. It's a brave thing offering photos of yourself barley clothed to the public. I can respect his wishes to revoke them too. I can imagine girlfriends or jobs might not like that kind of thing or understand it. ;p

Just to clear it up for those asking the photographer owns the rights to the photos unless he or she has signed a form giving those rights to others.

However it's not a good idea to be disrespectful of the models wishes. It is sad that such lovely stock is disappearing, but it is wonderful she is respecting his wishes. I wish him the best of luck in whatever he's doing now.

Can a photographer take a photo of someone on the street and then post that photo as something like Creative Commons that other people can then use?

I believe so, as long as it is public property and not invading the privacy of an individual. Also if there are signs restricting photography then obviously obey them.

It would still be polite to ask though! I have seen a lot of blogs of photographers who ask random people on the street if they can take their picture and from what I have seen most don't mind. The only time it can be an issue if someone is very recognizable in a photo and it is published by someone other than the photographer.

That is usually where the model release forms come in handy because it covers the publishers when they license the image. For drawing reference though unless someone is faithfully replicating the photo or just doing minor touch ups on a manip then it wouldn't be recognizable as the actual person anyway.

I hope that's not too confusing!

It's the stuff other than drawing reference that's of concern though. If someone took a photo of my and my husband sharing a little kiss while out on a beach stroll, then uploaded it to a stock site with a CC BY 3.0 license, they'd be allowing commercial use of our image without our permission. If that ended up on a billboard advertising something, don't you think that could be problematic?

Yeah if it is a recognizable image then the publisher can get in trouble for it. It depends on where it's published though. Like they haven't even defined all the rules yet as far as internet usage goes.

But in general no one has a right to privacy on public property unless they are in a changing room, restroom, doctors office, or some other place where you're supposed to be able to change. If you are sunbathing nude out on your lawn and someone can take a photo without entering your property then that is fine too, because by choosing to sit around outside naked you are putting yourself in the public eye.

The paparazzi do it all the time, they take photos of celebrities and sell them to tabloids. Most celebrities seem to hate being followed and photographed like that, but they aren't breaking any laws by doing so.

Yeah it is strange. And confusing haha! People can fight their image being used without their consent, but I believe for the most part it's only the person publishing it who gets in trouble and not the photographer. From what I understand anyway.

The model release forms are more for the benefit of the publishers than the photographer. Well it makes them easier to license to others. If a model signs it it proves they consented to be photographed and agree to images of themselves being used in the ways outlined in the agreement so that's really the best way to go about it.

While it's two bad that others will no longer be able to use his poses for reference, I am happy for two reasons:
